POL-POD Sir, We
refer to previous correspondence by reason of the above captioned
matter. After
a careful review of your claim and of all documentation available to
us, we can unfortunately not accept liability for the damage to the
goods. Our
investigation shows that the cause of the damage was the
insufficiency of the packing used. [Describe the problem with the
boxes or the palled builds, and explain how that caused the damage].
The transportation itself was carried out entirely in accordance
with your instructions and without extraordinary events, but when
the packing materials used are not sufficient, none of this helps:
there will inevitably be damage to the goods. Please see the
attached report for further information. We trust that you will
understand, therefore, that we are not liable for the loss in this
matter. This is also what follows from the applicable legal
provisions and the terms in the Bill of Lading. Please
feel free to contact us at any time if you have any questions about
this matter, of if there is anything we can do to assist you. Yours
sincerely, LCL
